UN experts ask France termination of the institutionalization of an autistic child in a psychiatric hospital

GENEVA ( 17 September 2015 ) - Experts from the UN Human Rights condemn the placement of a child with autism 16 years , Timothy D., in the psy
chiatric hospital for adults Vinatier The Lyon where it was subject to drug treatment without his consent or that of his mother.

This investment occurred just days after its placement in Medical- Educational Institute (EMI) . Until the teen enjoyed an inclusive education in mainstream schools and lived in his family. The reasons for placement in a psychiatric hospital are to date still not known her mother , who had been forbidden to see .

“The institutionalization of Timothy D. in psychiatry is a serious infringement of the right to liberty and security of person and respect for his physical and mental integrity * ," said the Special Rapporteur on the right of persons with disabilities, Catalina Devandas Aguilar . "It also violates the rights of the adolescent autonomy and inclusion in society, to live in his family and to express their views freely on all matters affecting them ."

“It is particularly serious that the best interest of the teenager, who has so far hardly been taken into account in decisions concerning them , was invoked to deprive him of seeing his family members ," added Ms. Devandas Aguilar .

Timothy D. The situation is even more worrying that in February 2014, the Council of Europe found a violation of the rights of autistic children the priority in enrollment in ordinary schools and lack of predominance an educational nature within the specialized agencies that support children and youth with autism.

"No student can be excluded from the general education system on the basis of disability and only the education systems inclusive type can provide persons with disabilities both quality education and the opportunity to improve their social situation" Devandas Ms. Aguilar said.

Since his institutionalization in EMI, the physical and mental health and well-being of the youth have deteriorated leading to his psychiatric emergency hospital where he was subjected to high doses of neuroleptics.

"As we have already informed the authorities, we are very concerned about the negative impact that the decision to Timothy D. in EMI could have on its right to the highest attainable standard of physical and mental health, as although on his welfare, "said the Special Rapporteur on the right to health, Dainius Puras.

"To ensure the right to inclusive education, particularly of children with autism, we strongly encourage the institutionalization and the creation of alternatives to institutional placement. We must go beyond the medical-social model of care and engage in a pattern of human rights based on non-discrimination, inclusion and participation, and the strengthening of family ties and structures social and community, "concluded Mr. Puras.

UN experts briefed the French state their concerns about the situation of Timothy D. and calling for an urgent end to his psychiatric hospitalization as well as the administration of its drugs alteratives health, such as neuroleptics. "It is essential that appropriate steps be taken as soon as possible to facilitate its return within the family environment and in order that his right to an inclusive education and social inclusion are finally respected," they said. The experts were available to the French authorities to lend every assistance on this subject.
